SMS Terms and Conditions

JC USA, Inc. and its affiliated companies (collectively, “Jenny Craig,” “we,” “us,” or “our”) offers mobile messaging programs through recurring SMS (Short Message Service) and MMS (Multimedia Message Service) text alerts (each, a “Program”), which you agree to use and participate in subject to these SMS Terms and Conditions (the “Agreement”). By opting-in to or participating in any of our Programs, you accept and agree to this Agreement. This Agreement is limited to the Programs and is not intended to modify the Terms of Service, the Privacy Policy, or other terms that may govern the relationship between you and Jenny Craig in other contexts.

Program-specific details, including the Program name, description, opt-in method, opt-out method, and help instructions are detailed immediately below:

MARKETING

Program Description: Receive automated recurring Jenny Craig marketing messages.

  • To Opt Out: Text STOP to 760-239-0029 to cancel

After you submit a request to unsubscribe, you will receive one final text alert from Jenny Craig confirming that you will no longer receive text alerts. No additional text alerts will be sent unless you re-activate your enrollment.

Message and data rates may apply. Jenny Craig has no responsibility or liability in respect of any messaging fees, data charges or other charges charged by your mobile carrier for the Program. Message frequency varies. Carriers are not liable for delayed or undelivered messages. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

User Opt-In: Each Program allows users to receive SMS/MMS mobile messages by affirmatively opting-into the Program, such as through the methods described above or through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join a Program, you agree that this Agreement applies to your participation in the Program and you acknowledge and agree that your information may be shared with third-party service providers who help administer the Program. Jenny Craig will not sell or otherwise share personally identifying information obtained via the Program. By participating in any Program, you agree to receive messages sent using an automatic telephone dialing system (“ATDS” or “auto-dialer”) or prerecorded marketing mobile messages at the phone number associated with your opt-in. Although you consent to receive messages sent using an auto-dialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an auto-dialer.

User Opt-Out: If you do not wish to continue participating in a Program or no longer agree to this Agreement, you agree to opt out of each Program through the method(s) described above. You understand and agree that the foregoing option is the only reasonable method of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than the word STOP or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

Program Descriptions: The description of each Program is provided in the table above and, without limiting the scope of each Program, users that opt-in to a Program can expect to receive messages concerning the marketing and sale of weight loss products, services, and events. The Program also includes shopping cart reminders and offers, which can only be redeemed through Jenny Craig's website or app.

Our Disclaimer of Warranty: The Program is offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, or coverage change or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with any Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of Jenny Craig’s control.

Participant Requirements: You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your device capabilities for specific text messaging instructions.

Changes to This Agreement: We may update this Agreement at any time, and we will post the updated version of this Agreement to our website. You understand and agree that you will be deemed to have accepted the updated Terms by your continued enrollment and/or participation in any Program after the updated Agreement is posted. As applicable, we will notify you of material changes to this Agreement via email or text message. We reserve the right at any time and from time-to-time to modify or discontinue, temporarily or permanently, any Program (or any part of it) with or without notice.
